Accessible parking off site

Existing bar/restaurant no off street parking. Gets sold new owners want to expand use to second floor and do total gut rehab. As part of variance to allow expansion to second floor ZHB required them to provide off site/street parking for 23 cars. Does zoning requirement kick in accessible parking requirement. No limitations were placed on how close the reserved parking had to be.
 
accessibility requires the accessible route to be closet to the accessible entrance..... so, if off site parking is created, then the accessible spaces required would have to be on the closest route possible to the accessible entrance.

1106.6 Location.

Accessible parking spaces shall be located on the shortest accessible route of travel from adjacent parking to an accessible building entrance. In parking facilities that do not serve a particular building, accessible parking spaces shall be located on the shortest route to an accessible pedestrian entrance to the parking facility.
 
Depends on if the off street parking for the bar is strictly for use by the bar or others use it also.

Example we have similar situations where the bank owns the parking lot and then leases it to the bar for use after 5:00. The accessible spaces serve the bank with the shortest route. I don't care about the bar that i will make them relocate a HC parking space.

Now if it is a general use or exclusivly for the bar then the parking lot HC spaces should be located as close to the access point for the public sidewalk
 
IBC Table 1106.1 Minimum required spaces with shortest accessible route kicks in

1-25 cars....1-ADA space require

26-50 cars..2-ADA spaces needed

51-75 cars..3-ADA spaces needed

New space with 23 cars would only require one additional ADA space unless the existing total and the new required spaces added together exceeds the chart requirement.

Minimums, more spaces can be added.

So it seems like we all agree here parking required even tho off site kicks in 1106. This means that even tho a site plan is not required for the renovation, a site plan is now required to show acc. parking and route to restaurant as part of the review.

Yes because the AHJ through a condition of the variance approval requires the business to provide parking.

The shortest route would not be as important as the most level route when distance is involved.

The business may not have any control over the route and distance if using existing public walks/bikepaths
 
Second floor? Elevator?.....Way more projects should probably have a site plan than actually do....if nothing else to verify egress to a public way and accessible route...
