Accessible window hardware

This was a response to my request for accessible window hardware in Type A barrier free dwelling units.

"We are having tremendous difficulty coming up with a real solution to the 'Window Operation" issue in the type A Units. We had proposed, in response to your correction that a Milguard 'Smart Touch', or equal be used for this purpose.

Our Accessibility Consultant has serious issues with the 'Smart Touch' product. In fact, he's indicated that in ANSI A117.1 (2009 edition), the requirements are being changed because it was "technically and often times practically infeasible to accomplish".

This leaves us with no solution. We would like to submit a revised Dwg. A400 that would indicate that Windows in Type A Units would comply with the standards noted in the attached ANSI A117.1 (2009 edition) Sections 1002 and 1003."

Seems like my week for accessibilty issues. Does anybody have insider information or thoughts on this issue?
 
Don't build a building with more than 20 units and then a Type "A" unit will not be required only "B" and the operable window requirement is not there.

Or don't provide operable windows
