accssible pool bar

2012 IBC/ANSI 2009. Pool bar has seating in the pool and outside of pool. Would the in the pool bar seating need an accessible space with knee space besides one on the outside the pool seating area? The floor in the pool is more than 40" below the bar counter. I don't know how it could be accessible except the would not be able to build the pool that deep. The pool is required to be accessible by a ramp or lift.
 
Methinks yes...They would probably have to create an accessible route to the pool bar (raised floor) and spot there at....Interesting question...

Those are not seats? What are they?

1108.2.1 Services. If a service or facility is provided in an area that is not accessible, the same service or facility shall be provided on an accessible level and shall be accessible.

1108.2.2 Wheelchair spaces. In theaters, bleachers, grandstands, stadiums, arenas and other fixed seating assembly areas, accessible wheelchair spaces complying with ICC A117.1 shall be provided in accordance with Sections 1108.2.2.1 through 1108.2.2.4.
 
1108.2.9.1 Dining surfaces.

Where dining surfaces for the consumption of food or drink are provided, at least 5 percent, but not less than one, of the dining surfaces for the seating and standing spaces shall be accessible and be distributed throughout the facility and located on a level accessed by an accessible route.

And I forget what gets us to the accessible spot at the bar right now.....Wouldn't ADA govern on the "equal experience" thing?
 
So if a pool is provided with a setting step along the side they have to be accessible

So do the seats shown also need grab bars?
 
If the pool is accessible, and it is a service in the pool, how is it exempt? I just don't see it, I know it makes some sense, but I would be trying to err on the side of caution....
 
You don't need grab bars or armrests in a dining room, why would you need them on a pool seat?

You do not need space for a wheelchair, If a disabled swimmer wants to sit they can. Remember bodies are relatively buoyant in water.
 
The pool must be accessible. Doesn't have to be just siting areas could be standing. Plans do show stools in the pool (not the smelly kind). But what if this not a dining area and they don't alow food in the pool but only a drinking area. The 2009 code says dining and drinking areas, but we are using the 2006 code for this job because the plans where made years ago but only sumitted now.

1108.2.9 Dining areas. In dining areas, the total floor area allotted for seating and tables shall be accessible.

Exceptions:

1. In buildings or facilities not required to provide an accessible route between levels, an accessible route to a mezzanine seating area is not required, provided that the mezzanine contains less than 25 percent of the total area and the same services are provided in the accessible area.

2. In sports facilities, tiered dining areas providing seating required to be accessible shall be required to have accessible routes serving at least 25 percent of the dining area, provided that accessible routes serve accessible seating and where each tier is provided with the same services.
