Air sealing behind gas fireplace

What's up with the flex duct? Is that legit? If the duct is legit, should there be worm drive clamps? How about the flat 2x that is oriented like a header? They are notched nearly in two.
 
Contractors in this area do fairly well with f.p. air sealing, its the csst thru metal f.p. frame. CSST is never protected from the frame, consistently ripped jacket from pulling thru metal frame.
 
insulated at the envelope. In the unlikely event you decide the fireplace is on the "exterior" wall, that's where you seal and insulate.
