The manufacturer of the brand of cement backer board used on a project specifies that coated screws be used in an 8 inch square pattern to secure the board.

Yes, the manufacturer's installation instructions are the minimums

If the code specifies a screwing pattern and the manufacturer does too, the more restrictive applies. So if the code wanted 1-1/4" screws every 10" and the manufacturer wants 1-5/8" screws every 8" then you have to put the 1-5/8" screws in every 8".

I have a problem in a kitchen with some loose tiles. Instead of using screws every 8 inches per the manufacturers instructions, the installer used nails approximately every 12 inches. The job was overseen by a builder.

If you pulled a permit and had the drywall and backer inspected, it should not have happened.

The work was permitted. I don't know if this stage was inspected. It was performed several years ago.

Some tile is loose and some has cracked.

I am not a tile person, but have messed up tile,

Maybe bad install job on the mortar to hold the tile in place?

Maybe water has gotten behind the tile and loosened it?
