CalGreen Non-Residential EV Capable

We have a project where we are providing 57 parking spaces. Half of the spaces will have Level 2 EV Chargers (EVCS), and the other half will have Level 2 EV Receptacles (EV Ready). There will be no EV Capable spaces as we are providing all spaces with charging ability from the beginning. My understanding of note #2 below is that CalGreen recognizes that EVSE spaces are superior in in terms of the EV capacity that a development is providing. Our take is that EVSE spaces count towards the required EV Capable spaces, and we don't need to provide them since it will defeat the purpose of what this section is trying to achieve. Our client is questioning this, and wondering if we need to request a variance since we won't be providing EV Capable spaces. I have reached out to the CEC for confirmation but I have not heard back.
Has anybody run into this or have any insights?

I think footnote 2 is clear. I don't see a need for a "variance" or anything like that.

What was the application date for the permit? Specifically, before or after July 1st. 2024?

Thank you! The project will be submitted in November of this year, so after.
 
Good, they added a bunch of stuff in the mid-cycle amendments. But those only apply to projects submitted after that effective date. You're good.
