The job is a furnace and A/C replacement. A well known contractor. You can bet that he's gonna say, "That's the way it was"

Is the disconnect new too? it sure looks like it. Both items are new so neither is existing. Even if just the AC was replaced, the new unit can't block access to the disconnect, especially since chances are the new unit might be physically larger than the old one. That's about a 95% possibility if the old unit was R-22. Why didn't they just set the new unit 3" farther over? It just amazes me what some installers do to themselves.. This is something they may have to come back and work on....
 
Most manufacturers will let you get down to 6" on one side, but you still can't block access to other items.
I have represented 7 of the major ac manufactures and have worked on the majority of the others and have never seen 6'' on any.
What most people and quite a few installation companies fail to comprehend is that the minimum clearances are there to allow the equipment to run efficiently.

Above the unit is as critical as the sides in order to reject heat.

110.26a is often overlooked and makes for a hazard for the technician working on the unit.

I've worked for both a Carrier dealer and a Lennox dealer in the past, both have allowed 6" on one side for years. These are typically two of the more fussy manufacturers that I've seen.
