I'm working on a level II alteration. The tenant space is factory 1 (they make prosthetics) and business. Building is type II construction. They have built a wood framed storage mezzanine (ladder access) over a portion of the office that overlooks their assembly area. Obviously unprotected wood framing is not allowed in type II construction. Can I complete the alterations to the rest of the space and simply gray out this area and indicate "not in contract" or will I have to have them demo this?
 
Can the building be re-classified as a V-B
It seems like it could re-classified as VB, the building is only 30K sf. I just wonder what implications this might have for leasing the other suites in the future, the only time this might come into play would be if there was maybe a hazardous use, which I don't come across very often.

regardless of if it is an actual mezzanine, it is structurally framed out of non-FRT wood in what is currently classified as a type IIB building. The previous suggestion of reclassifying it as VB may have some merit, can you think of an reasons to not re-classify it as such?

Check with the insurance company. I am not familiar with commercial fire insurance but there might be different rates for type of construction. Or they might never know.

Whether or not you call it NIC, if this mezzanine is within a room or space in which you are doing alterations, it's within the work area and should be brought into compliance. The building code doesn't care about whether something is in the contract. The code is concerned with whether or not the building meets code.

Yeah, I know… I was hoping someone would have a magical answer because the tenant isn’t going to want to hear it.

Sounds like it could be a wooden shelf which is allowed.....it has no stairs, so it is not a floor.......

I would not classify it as a shelf, it is framed out of 2x4’s with 3/4” plywood and spans over the metal framing that forms the walls below. They are storing plastic parts in boxes above.
 
You indicated that the building was sprinklered, is the office sprinklered and the space above sprinklered as well?

Can the plywood floor be covered with a fire retardant floor covering?

The office is sprinklered, the warehouse space is also sprinklered. the space above the wood storage is not sprinklered.
