Guess I'll start the ball rolling.....
The contractor that poured the garage slab that I posted in another section is very, very young and his dad, who owns the licence, has left him in charge while he is on a mission in Central America. This young man (23) and his even younger brother (20) are doing the work along with the butcher (seriously), and possibly the baker and candlestick maker. I am pretty fed up with the whole bunch of them.
The licence is technically held by a limited partnership, the dad and two sons. They do not have workers comp for the 'extra help' and claim that they are exempt because they are a religious group. He then changed the story and said their attorney said the 'extra help' could buy into LLC for day(s) they are working.
I busted them last summer with a teenager (15-16 maybe) on a job and gave the older son a copy of the State of California Labor Law pertaining to the employment of persons under the age of 18 on a construction site. Response to my being helpful and concerned for him getting a fine from the State Labor Board was something to the effect that the teen's dad had asked him to teach the teen construction and that their religion required this type of training. Huh? I have respect for training the young people, but, state law is state law. Nevermind the fact that the two young men are still learning.
Anybody think I am wrong with this line of thought? And what would your reponse be to both the workers comp issue and the labor law issue? I would really like for those of you from the midwest and PA to respond as this religious sect is prevelant in your areas.
Anybody from CA conversant in Contractors' State Licence Law in reference to aforementioned issues?
