Do I need an A/C unit for a commercial mercantile space?

I have a client who wants to put a bike shop in Rochester, NY an existing warehouse space that only had radiant heat. We are putting in a new ducted furnace for heat but he wants to save money by not putting in A/C. We will have to rely on mechanical ventilation as there is now plan for operable windows to take care of natural ventilation. The entire space is roughly 3,100 SF and will be a mix of retail, storage, office. Anybody have thoughts on this? Thanks.
 
Air conditioning is not required, only ventilation and heat.

If that was in my jurisdiction it would be allowed. We follow the 2009 IBC, not sure what code NY follows.

"as there is now plan.." Do you mean there will be no operable windows? If so, then mech. ventilation is required. I don't see any mention of a cooled/conditioned air requirement. It is possible to bring in unconditioned outside air using the furnace return duct to draw the air in.
 
There was a proposed code change for the 2015 code cycle to require a/c in certain climates, but the committee voted against the code change. So as it stands, a/c is not required.
 
Thanks guys. I confirmed with a local engineer and he agreed a/c is not required. But we do need fresh air change over. I certainly would not want to work in the space when it's done.

Who assures the ventilation system is turned on, or the heat or the AC? Last I checked any of these systems can be turned off.

IMC Section 401.3 When required. states Ventilation shall be provided during the periods that the room or space is occupied.

Doesn't this say that doors and windows used to provide natural ventilation must be open when the space is occupied?

But I agree, good luck enforcing it.

That is what your kids are for--Shut the door we don't want to own more of the power company (we are members of a co-op)
