Egress Balcony help

Is a walkway that is over a podium below grade garage considered an egress balcony? R-2, type VB building.
I have had several similar projects that this had never come up, but now I have one in plan check under 2016 CBC and the comment received was that the grade level walkway is considered an egress balcony because it is over the garage and not over grade. Would not be that bad except the walkway is in the setback adjacent to the property line.

Yes, It is four residential units that the front door exits to the side setback walkway which is over a podium garage

Do you exit a unit and turn left or right or go straight to the street??

How do you get to the pubic way??

1021.1 General.
Balconies used for egress purposes shall conform to the same requirements as corridors for minimum width, required capacity, headroom, dead ends and projections.

No it is not a building separation at the podium.
