Egress through Tenant space via a fail-safe door

Is the condition, as illustrated below, compliant with IBC? Or does that egress stair need to be accessible regardless of fire?

More detail would help, both about the buildings' arrangement (multiple tenants? single tenant? multi-level, which level is lobby and tenant on? etc?) and which Code Edition along with State or Local amendments?
 
You would have to look through 1008, it is pretty complicated and terms like fail safe and fail secure make it even worse. We would need alot more information to determine code compliance.
 
So I take it you cannot walk from the elevator lobby to the stairs without a card or fob or something else to be able to open the door???

We have a similar situation in several state office buildings, including our former office and the state building official's suite. The door has a delayed-action panic bar which sounds an alarm then releases the door after 15 seconds.

and the problem is???
 
There is no problem with the exiting with the delayed egress panic bars if AHJ allows, but the suite can never really be secured. That is the problem.
