I'm working on a restaurant design project, A-2, IIIB, three-story (Basement, First and Second). Basement is incidental storage and First and Second Floors include primary-function services, ie: dining tables and chairs. The building is existing and will be completely gutted and redone. Applicable Codes are IBC 2006, Existing Building Code 2006 and ANSI A117.1. I am trying to determine if an elevator is required.

When working on a previous project and trying to determine if an elevator is required, I recall a section in the IBC that noted an exception. It stated that elevators are not required in buildings three stories or less, less than three stories... or something similar to this. I can't seem to locate this exception, but I do recall seeing it. Can anyone cite the section of the IBC 2006 where this exists? Thanks in advance for your help.
 
1104.4 Multilevel buildings and facilities.

At least one accessible route shall connect each accessible level, including mezzanines , in multilevel buildings and facilities.

Exceptions:

1. An accessible route is not required to stories and mezzanines that have an aggregate area of not more than 3,000 square feet (278.7 m2) and are located above and below accessible levels. This exception shall not apply to:



1.1. Multiple tenant facilities of Group M occupancies containing five or more tenant spaces;

1.2. Levels containing offices of health care providers (Group B or I); or

1.3. Passenger transportation facilities and airports (Group A-3 or B).

2. Levels that do not contain accessible elements or other spaces as determined by Section 1107 or 1108 are not required to be served by an accessible route from an accessible level.

3. In air traffic control towers, an accessible route is not required to serve the cab and the floor immediately below the cab.

4. Where a two-story building or facility has one story with an occupant load of five or fewer persons that does not contain public use space, that story shall not be required to be connected by an accessible route to the story above or below.

5. Vertical access to elevated employee work stations within a courtroom is not required at the time of initial construction, provided a ramp , lift or elevator complying with ICC A117.1 can be installed without requiring reconfiguration or extension of the courtroom or extension of the electrical system.

...and thank you mtlogcabin. I did see that section. I recall there being an exception in IBC specifically related to a three-story building, but can't locate it now. I'm starting to wonder if I'm confusing it with an ADAAG requirement...

2004 ADA/ABAAG

206.2.3 Multi-Story Buildings and Facilities. At least one accessible route shall connect each

story and mezzanine in multi-story buildings and facilities.

EXCEPTIONS: 1. In private buildings or facilities that are less than three stories or that have

less than 3000 square feet (279 m2) per story, an accessible route shall not be required to

connect stories provided that the building or facility is not a shopping center, a shopping mall, the

professional office of a health care provider, a terminal, depot or other station used for specified

public transportation, an airport passenger terminal, or another type of facility as determined by

the Attorney General.
 
IBC 3411.7 exception #1 the cost of providing the accessible route are not required to exceed 20 percent of the cost of the alterations affecting the primary function. I know that the commentary is not code but it uses the example of providing an elevator pit only (no elevator) in order to meet the 20% requirement. A cost analysis of each area of the project would be needed if you wanted to use this exception.
 
1007.2.1 Elevators required.

In buildings where a required accessible floor is four or more stories above or below a level of exit discharge , at least one required accessible means of egress shall be an elevator complying with Section 1007.4.

Exceptions:

1. In buildings equipped throughout with an automatic sprinkler system installed in accordance with Section 903.3.1.1 or 903.3.1.2, the elevator shall not be required on floors provided with a horizontal exit and located at or above the levels of exit discharge .

2. In buildings equipped throughout with an automatic sprinkler system installed in accordance with Section 903.3.1.1 or 903.3.1.2, the elevator shall not be required on floors provided with a ramp conforming to the provisions of Section 1010.
