Exit access question

I have a M occupancy located on the 1st floor of a building with a basement occupancy underneath in the basement. That basement occupancy is currently unoccupied so it has no classification as of now. The DP has indicated that the basement exiting plan uses a set of steps up into and through the new proposed M occupancy on the way out of the building. The area that is being used as the exit from the basement is open to the M and now contains drinking fountain. Not sure this is permitted by 1016, but if it is would that exit not be required to be an exit enclosure/corridor/passageway and be rated per 1020.1. Also, then the drinking fountain would not be allowed inside the exit enclosure per 1024.1? Building is type V, non-sprinklered, basement is 5500sf and proposed M is about 1/2 that. And, just in case, would the drinking fountain be permitted to be on the other side of the exit access, essentially requiring travel through the exit access to get to it? Not sure the DP will go that way but you never know.

Can you Call it a vestibule, which is defined differently than a passageway
 
First problem I see is that you seek to classify the space first as a Corridor (an Exit Access component), then as an Exit Passageway (a component of the Exit).

It's either one or the other, but not both.
 
Is the another exit out of the basement?

Seems like at least the basement needs to be sprinkled??

What edition of IBC??

11. A shaft enclosure shall not be required for floor openings created by unenclosed stairs or ramps in accordance with Exception 3 or 4 in Section 1016.1.

3. In other than occupancy Groups H and I, the exit access travel distance to a maximum of 50 percent of the exits is permitted to be measured from the most remote point within a building to an exit using unenclosed exit access stairways or ramps when connecting a maximum of two stories. The two connected stories shall be provided with at least two means of egress. Such interconnected stories shall not be open to other stories.

4. In other than occupancy Groups H and I, exit access travel distance is permitted to be measured from the most remote point within a building to an exit using unenclosed exit access stairways or ramps in the first and second stories above grade plane in buildings equipped throughout with an automatic sprinkler system in accordance with Section 903.3.1.1. The first and second stories above grade plane shall be provided with at least two means of egress. Such interconnected stories shall not be open to other stories.

1016.1 Travel distance limitations. Exits shall be so located on each story such that the maximum length of exit access travel, measured from the most remote point within a story along the natural and unobstructed path of egress travel to an exterior exit door at the level of exit discharge, an entrance to a vertical exit enclosure, an exit passageway, a horizontal exit, an exterior exit stairway or an exterior exit ramp, shall not exceed the distances given in Table 1016.1.
 
Is it possible the drinking fountains are not required?

Correction, One high and One low meeting 1109.5.1 would be required up to 1,000.
 
If DF's allowed they may not project/obstruct the POT and must be in an alcove or provide side railings.

Since the spout must be at 36 Min. for lo, and a range of 38-43 for high, they definitely protrude more than 4" above 27 inches AFF.
And IBC.....

1003.3.3 Horizontal projections. Structural elements, fixtures or furnishings shall not project horizontally from either side more than 4 inches (102 mm) over any walking surface between the heights of 27 inches (686 mm) and 80 inches (2032 mm) above the walking surface.
 
Does the upper door (EXIT) lead outside or into another room? You could consider this space a Vestibule if that door leads outside.

If that door doesn't lead outside, then you have to maintain the level of fire protection until you are outside, which could be very challenging.

I don't think the drinking fountain protrusion should be a problem. They are out of the path of travel, and the low one, which usually has a skirt that is within 27" of the floor, is on the approach side.
