External elevator hoistway protection requirements

I have two questions regarding a request for an external cargo elevator on an existing, non sprinklered two story building, 65% Business and 35% S-1 Storage.

The only suitable walls for the elevator are the protected stairways on each side of the main corridor on the first floor. The architect proposes the hoistway opening directly on the protected stairway on the first floor. Normally this is not permitted (3002.7 Common enclosure with stairway. Elevators shall not be in a common shaft enclosure with a stairway.)

Nevertheless, taking into account that the door on the ground floor will be an outside door, could we ignore this restriction?

Also, since three sides of the elevator shaft will be outside, does the hoistway still need to be rated?
