Flower Shack Conversion, CMC 1204.1 & 2016 CEnC 140.4(n)

Converting an existing flower shack to serve beer for a beer garden. Mechanical code requires heating but energy code requires shut off for operable windows. The shack will only be used when the front service window is open so the heating system will never be operable when the space is occupied. Logic says there's no point in installing a heating system, the code says otherwise and is in conflict with the energy code. Anyone have experience with this requirement and similar uses such as small flower shops, parking lot attendant sheds and guard shacks?
