A national non-profit is claiming Kohl’s stores in Chicago and six suburbs are violating disability standards by not being wheelchair accessible.

The lawsuit was jointly filed Tuesday in federal court by Washington D.C.-based Equal Rights Center and six other people, including an Illinois resident who claims stores in Gleview, Arlington Hegihts, Niles and Vernon Hills have presented maneuvering problems for her wheelchair. Kohl’s Corporation and Kohl’s Department Stores were named as defendants.

Devora Fisher, a member of the ERC, has been living with a cerebral abnormality known as agenesis of the corpus callosum since birth, the suit states. She also suffers from scoliosis and requires a wheelchair to get around.

The suit claims Fisher frequents Kohl’s stores to buy supplies for her picture frame company, Frames by Devora.

Since Oct. 2012, Devora has noted all four stores lack accessible routes between aisles, fixed displays and moveable displays. Some of the stores also have narrow checkout aisles, tall customer service desks and furnite blocking restroom access.

Devora’s legal guardian, Sheila Fisher, has told store and regional managers about the accessibility issues and was “assured” they would be taken care of. Fisher sent Kohl’s CEO and president Kevin Mansell a personal letter in 2012 regarding the barriers, but no changes were made. In some instances, the number of inaccessible aisles have increased, the suit claims.

The ERC claims it canvassed and found accessibility issues at Kohl’s stores in Chicago, 2140 N. Elston Ave.; Burbank, 7608 La Crosse Ave.; and Elmhurst, 303 S. Route 83. It also sent letters in December 2012 and 2013 to Mansell, advising him on the barriers, but received no response.

A Kohl’s Corporation representative did not respond to messages for comment.

The suit claims the company is violating the Americans with Disabilities Act and New York Human Rights Law. Plaintiffs are asking for Kohl’s to comply with ADA standards, award the ERC punitive damages and provide compensation for legal fees.

Notice she is completely dependent on her handler, so things like counter height have no bearing on her whatsover.

But since is a local minor celebrity they (the equal rights mob she apparently has membership in) certainly has no problem using her for their goals.

I wonder how accessible the little doggy store is that her wares are sold in.

Okay, but I'll elaborate: LBJ gave us three disastrous policies, Civil Rights laws, the Viet Nam war, and the War on Poverty, of these three I think Civil Rights Laws are the most damaging to this country. We are all supposed to be equal under the constitution in this country, Civil Rights laws give us an Orwellian "All animals are equal, but some animals are more equal than others." Ground zero in this unconstitutional law is the educational system that has been ruined, two Princeton sociology professors wrote a book on the effects of civil rights law at elite educational institutions:

The authors provide a fascinating peek inside the admissions process at several unnamed universities, which are roughly representative of the top fifty in the U.S. News & World Report’s rankings. In the class entering in 1997, the authors find, racial preferences were far more significant than the proverbial “tiebreaker” at the selective private universities studied. Espenshade and Radford report that blacks received an admissions ***** worth 310 SAT points compared with whites. Hispanics received a 130 point preference, and Asians received a 140 point penalty compared with whites. Taken together, on average, an Asian American student must score a whopping 450 points higher on the combined math and verbal sections of the SAT to have the same chance of being admitted as an African American applicant. By contrast, Espenshade and Radford find that socioeconomically disadvantaged students receive a much smaller preference. Students identifying themselves as “lower class” received a 130 point ***** over middle class students, who in turn had a 30 point advantage over upper class students. And while selective private universities favor low-income minorities over wealthy minorities, controlling for academic ability, low income whites are three times less likely than upper middle class whites to be admitted. This may be true, they say, because universities want to “save their scarce financial aid dollars for students who will help them look good on their numbers of minority students.”¹
All colleges used to grade on the curve with a flunk out rate of about 25% to 33%, after the Civil Rights Act professors were forbidden to flunk out minorities, they started giving everyone As, Professor Harvey Mansfield has exposed this, now that admissions are based upon "diversity" instead of brains a college degree is mostly worthless. And yes, the disabled are part of the diversity formula. BTW, they have lowered the bar for the SAT so low that last year both Harvard and Stanford had more perfect SATs apply than they had admission slots, this year the ETS is even eliminating the written portion so that ignorant applicants who can't even write an essay can be admitted. Giving special privileges to the disabled is akin to giving special privileges to other minorities. To give blacks preference over Asians discriminates against Asians, giving the disabled preference over the able bodied discriminates against the able bodied. Nobody knows what this law has cost society, but it's estimated in the trillions, it not only harms businesses but it harms the tax payers as cities scramble to make their facilities accessible, at times using accessibility as an excuse to build now city halls, stadia etc. In a free country if Kohl's doesn't think accessibility is worth the expense then they shouldn't be forced to comply. Maybe we should all claim we are disabled, get blue parking cards, free parking etc. Elizabeth Warren claimed that she is Indian and was admitted into Harvard Law School, then became a professor there based upon her minority status, and is now a U.S. Senator.With the breakdown in our educational institutions a quote from the famous H. Did you know that with ADA and "separate is not equal" doctrine retarded children have the right to be "educated" in the same classrooms as normal children? This brings the top down, not the bottom up.

OK, I'll let it fly but it is more of a political post than it's relevance to the original post. I believe that you took advantage of this thread to voice your opinion on a subject not relevant to the thread. If a moderator did want to remove it, I would not argue it or change it back. I see your point but the same dead horse has been beaten multiple times.

Yes I have made the point multiple times, but Mark keeps posting these things ad nauseum, why does he keep posting them? What are his agenda? This country is bankrupt because of things like this, how long can the Federal Reserve keep printing money, especially with the BRICS now starting to trade in their own currencies? Everything needs a cost/benefit analysis, in most cases with ADA the costs far outweigh the benefits.
