Name That Violation - Generator Situation

This generator was replaced, and we were supposed to reconnect the new one, but there was a problem when we got there and saw the existing wires in the conduit. I will give you that much of a clue. Look at the wires. This is not an issue of wires that are too long or too short. It is something obvious. What do you see, or what don't you see? I did this job with @chris kennedy about 7 years ago while waiting for my inspector licenses to be transferred and approved in Florida.

310.8 Marking.
(A) Required Information. All conductors and cables shall be
marked to indicate the following information, using the applicable
method described in 310.S(B):
(1) The maximum rated voltage.
(2) The proper type letter or letters for the type of wire or cable
as specified elsewhere in this Code.
(3) The manufacturer's name, trademark, or other distinctive
marking by which the organization responsible for the product
can be readily identified.
(4) The AWG size or circular mil area.
Informational Note: See Chapter 9, Table 8, Conductor
Properties, for conductor area expressed in SI units for
conductor sizes specified in A WG or circular mil area.
(5) Cable assemblies where the neutral conductor is smaller
than the ungrounded conductors shall be so marked.

How do you know all that information isn’t marked on the jacket?

I don't know that it is or isn't but based on the OP "or what don't you see?" comment, I don't see the required marking. Also, from my own personal experience local contractors can go to supply houses (or some guy's storage unit, who knows) and buy conductors that don't have the required markings. They're a lot cheaper, and the POCO uses them everywhere, so why not? 310.8, that's why. POCO doesn't have to follow NEC.
 
Wayne had it right, No EGC with the FMC. We ended up pulling out all of the existing wires and pulling in new wire with an EGC. We could not pull the EGCs through the filled pipes. FMC is only rated for 20A as a replacement for the EGC.
