How many of you have the ability by local ordinance or state statute to reference NFPA 101 beyond the 2 references in the IBC and IEBC? Do you have the NFPA 101 adopted or Fire Department only?

When a new building receives a CO, does fire then apply 101? And using the requirements - chapters - for existing?

NFPA 101 2012 edition is used for the following facilities in Montana.
All new construction, remodeling or modifications to licensed and certified health care facilities shall be presented to the Montana Department of Public Health and Human Services (DPHHS). Licensed and certified facilities in Montana are: Ambulatory Surgical Centers (ASC), In Patient Hospices, Critical Access Hospitals (CAH), Long Term Care (LTC) Facilities (nursing homes), and Acute Care Hospitals.

Florida takes NFPA 1 and NFPA 101, amends it, then publishes the Florida Fire Prevention Code (FFPC) and requires enforcement across the entire state. The first half of the FFPC is NFPA 1 and the second half is NFPA 101 with the aforementioned amendments.
Fire Departments enforce the FFPC and the Building Department enforces the FBC. There are a lot of dual responsibilities on permits. I don't have to look at Fire Sprinkler permits, other than the electrical if they are changing a pump motor or controller. The FD handles FS & FA permits. With Fire Alarm, there is some overlap. The FD looks at devices and placement and does the final inspection with the testing. The BD looks at wiring methods and power but not the location of devices or any testing. There are some municipalities in Florida that keep the fire side in the BD but the BCO is usually the Fire Marshal too.

Here is an example of a Florida specific change. This is what keeps the Building Department away from the FFPC unless the BD has personnel that are certified as a Fire Safety Inspector.
