jar, can you give us a little more info, not sure what I'am looking at in your pic?

Is that a ground rod, ground wire and clamp at grade?

You just have to be open minded about this. Read 250.32(A). Maybe they think this is a separate structure feed by a branch circuit. Nothing says you have to use the exception to this code section. (I am using the 2008 NEC).
