The City just issued a cease and desist order on a bio-diesel production facility. I made an inspection and immediately attached a notice of nuisance with a laundry list of health and safety violations. I won't get into the details, but I am trying to determine the occupancy group. My understanding is that bio-diesel is a Class IIIB liquid; therefore under Table 307.1(1) of the California Building Code, if they have more than 13,200 gallons in the building it is a H2 or H3 occupancy. When we were on site they had approximately 23,000 gallons in various stages of development. This facility was totally constructed without permits and it came to the my attention only after an approximately 1,000 spill, some of which got into a tributary to a creek.
