Greetings all,

So I've got an existing cafe with a type I hood over the cooking equipment. The roof is a flat roof. Bear in mind this has been there for some years now. The building owner is also a roofing contractor. He addded on the appropriate structure etc for a pitched roof over the flat roof. Sure nuff, they come and add onto the existing exhaust duct by fabricating an aluminum duct to slide over the existing duct to penetrate the new, higher roof level. No permit for the duct work, no inspection. The existing portion of the duct would not pass the clearance requirements where it passes through the old existing roof but it's grandfathered as I see it. Now, the new duct could made to be ok except that 1 it's aluminum 2 not welded and did not pass a light test.

I really don't want to make them tear it out but, the new section of duct is clearly not to 09 IMC standards. I feel like I'm backed to the wall on this and should issue a stop work order and have them fully comply with the Code for the new section of exhaust duct.

Differing opinions?

Yes, comply with 2009, but I might also get the clearance needed for the older section, if you have any way to do that (fire code???)
 
Definitely have them bring it up to code. Here you can leave an existing nonconforming installation but you can not extend one.

This was my thought as well, it could be grandfathered if it was not part of the alteration but now it must comply
 
If my grandfather inspected it and approved it as is, then maybe they have a gripe,

but if it was not installed correctly in the first place, the first install, then they have no grounds to stand on
 
Definitely make them comply with new work all the way through, proper clearance, black iron welded seams, liquid tight. Had a fire in a greasy burger place a little while back, they swear and the tags said they were clean in the past 60 days before the fire. Looked like a candle coming out the roof fan. Proper installation saved the building, out of business for a month while cleaned, new hood fabricated and installed. BTY the nozzles on the extinguishing system were so greased up nothing came out then the system was tripped by the manual pull.

Greetings all

Why am I not getting the pics? All I see is a red X. That bldg owner is coming to my office in a bit to go over what needs to be corrected by the way. It would be nice to show him some pics. A friend of mine told me a hood fire took out a whole bldg in Houston recently. Spooky stuff.

You need to insert a quarter for each picture into your computer coin slot!!!!!!!!!!!!!
 
They also did not install any guards on the roof for fall protection. See Section

304.10 in the 2006 IMC.

And if the architect would have taken into consideration 306.5.1 this equipment could have been cleaned and serviced, but that was probably not esthetically pleasing for McD's they are fortunate they didnt loose the whole structure
