Personal care homes

Just an update.

Attorney agrees with me that zoning violation is not there, says that the landlord may break lease if he thinks the neighborhood is in danger, and that the neighborhood, if they band together and go to the district attorney, can talk him into addressing a threat to safety presented by a resident with a violent history.

Interestingly he forwarded me a note about our state having agreed with the fed govt to place a minimum of 9000 patients with similar disabilities in least restrictive, most integrative community settings and away from the more restricitive institutional settings over the next five years.

I suppose this is the evolution of rights of the disabled to be included in the community to the max degree possible.

Deinstitutionalization and an emphasis on community health care goes back to the 1960's.

Yes, and the Bill of Rights goes back to the late 1700's. It has yet to be fully and fairly applied.

This issue is not going to go away, and in fact, it is going to become worse.

A lot of states and cities do not have the funding or facilities to house

patients / individuals like this.......Increasingly, there is an ongoing revolving

door at municipal jails & prisons because of the lack of facilities to treat

/ house / care for individuals who need long term care and supervision.

IMO, I believe that the codes will, at some point, have to address these

types of evolving facilities and "provided care"........Like most other things,

if the Feds., and individual states and jurisdictions do not step up, ...the

private sector will!

Some questions to the viewing audience:

It's "your" [ non-gated ] neighborhood. What level of security do your

expect / perceive that you should be afforded?.......Do you believe /

expect that the amount of property taxes you pay provides enough

protection for your family from the jurisdictional services?......Would

you want one of these facilities / "care homes" next door to your

family? If not, then where?.....Yeah, it's going to be a "Zoning"

issue in the future.

they seem to be talking about personal care homes or mini nursing home in a residental house, and if they are allowed in a city, and what code requirements can be

of course they did not get off topic
