R-3 or R-2?

2009 IBC in PA, is a single dwelling unit, in a building with a B Use Group, and it is more than 3,000 square feet so no live/work, an R-3 or an R-2?

I really do not see a difference in code requirements except in the sprinkler design if required to install one in PA.

I’m not familiar with the PA IBC so I’ll assume its similar to the IBC. I would call it an R3, if you call it an R2 you may run into accessibility requirements (i.e. Type B Dwelling Unit).

The owner is proposing to live there and the B use will be his art gallery. The gallery exceeds 10% of the building.
