Remodel to existing furnace system.

Given:

Three story six-plex apartment unit with existing ductwork passing through the interstitial floor-ceiling space.

IBC 712.4 would require a fire damper where supply duct from furnace penetrates through the fire-rated drywall ceiling and then radiation dampers at each air diffuser. But that is NOT the case with these ducts that pass in and out of the rated floor-ceiling assembly.

Question:

Considering that these apartments are replacing the furnace and air supply diffusers, is there anything in the code that require these existing conditions to comply with current code?

2006 IMC 102.2 Existing installations.

Except as otherwise provided for in this chapter, a provision in this code shall not require the removal, alteration or abandonment of, nor prevent the continued utilization and maintenance of, a mechanical system lawfully in existence at the time of the adoption of this code.

I do not believe you can require the fire dampers.

If they change the ceiling air diffusers then you could require the radiation dampers. JMHO
