Safe Harbour exception for 2010 ADASAD

Strip center built in 92' to ADAAG with an allowed ramp from adjacant raised walk descending into access aisle.
2020 driveby sues for noncompliance. Existing center has had no remodels since initial construction, 2010 ADASAD says it is safe harboured if compliant with ADAAG,
Agree?
 
Had the same issue with a Restaurant, They went to court, judge threw out the case and required the complainant to pay the legal fees of the restaurant.
 
Hard to believe no remodel since '92.
Any non-permitted remodeling happen?
no, only lease change to month to month; project is owner built and continues to manage. All dwg's approved and inspections signed off. Meets CBC of the day back then.

Thank you MH, law firm is being stubborn but so is defendant. Federal court Mediator doesn't seem to get it, next step to request a dismissal.
