It was a final inspection for a demolition permit. The planning dept. forced the owner to remove 800 square feet of patio cover that wrapped around the perimeter of the back yard.

When I told the owner that he wasn't done he said that the patio is no longer covered and he intends to keep the posts and beams. I asked him why and he stated that he will use the frame to hold up tarps when he has family events.

The violation is the setback requirement. 5' side yard and 15' rear yard. Few things are allowed in the setback and this isn't one of them.

Is there a maximum height of a fence in the zoning code? It's 6' here, so the choice would be to remove or cut the posts to 6'. Point being, if he wants to call it a fence, who am I to argue.

Once he puts a tarp on it, I believe he is violating Fire Code for having a membrane structure too close to the PL.

How about Art? Whatever he calls it, it is half of a patio cover that he agreed to remove.

It is a structure, less that 12 ft high, over a patio slab.... it is a patio cover and must be removed

They are structures not in compliance with the minimum setback. At least in the side yard, it is hard to tell which is the rear.

I would have to agree that this is a structure, at least in this jurisdiction, anything over 6' is a "structure" and must comply with setbacks.

BTW, in the 2012 IBC/IRC, the fence exception goes to 7' now. Our zoning still says 6', told my CD Director we need to reconcile this one way or another.
