Separation between B and S-1

Table 508.3.3 (2006 IBC/2007 CBC) indicates that no separation is required between B and S-1 occupancies. Our plan checker is telling us that because the area of S-1 is over 3,000 s.f., we are required to have a one-hour separation, based on what he is reading in footnote "b" of the table. He is saying that since we don't comply with any of the three conditions of footnote "b", then we have to provide the separation.

I've read the Code Commentary, and it appears that footnote "b" applies to separation between S-2 storage and B or M occupancies.

So, just a simple question: Does the code rated separation required between S-1 and B occupancies?

More complicated arguement that you MIGHT want to try...

Following the Plan Checker's reasoning, (which is flawed), he says note b applies. Note b says separation is not required if the (blah blah) is met. Since (blah blah) is NOT met, then WHAT DEGREE OF SEPARATION IS REQUIRED??? Let him substantiate his answer per the code. Notice that the code is silent on this, since no separation is initially required for B/S1. Note b is an exception. Exceptions are only applicable to where a requirement initially exists. Therefore, Note b applies to B/S-2, as the commentary clearly states.
 
I have actually hand written a note in my code book for footnote b which states that it is for S-2 not S-1.

No separation required for B/S-1
 
2009 IBC removed that footnote lanquage and moved everything up one place. Looking at the new table it is clear an S-1 does not have to be seperated from a B occupancy.
