Service upgrade and existing building

NEC 2008 ~

An existing building with mercantile first floor and two dwelling units on the second floor, panel is completely replaced. What is the requirement (if any) for requiring ARC fault and GFI to be added (assuming none existed originally)? If no requirement (and, I can't find one in the NEC), as an AHJ, do you think I can reasonably require such under chapter 34 or section 115 (or other)?

Service upgrade does not trigger further electrical upgrades in our jurisdiction.

Don't have the NEC in front of me, but aren't AFCI's a residential requirement only?

Not here, and we require it only if rewiring dwelling unit of more than 50% :) I am unaware of anything triggering this with a simple panel upgrade in the NEC. However it does raise the question as to why the panel upgrade :?: Generally new panels indicate they are requiring more circuits, branches, adding equipment....

The apartments are residential, although in a commercial building, they have to comply, yes?

Panel replacement due to a vehicle accident (yup). Former panel not to code in a number of ways.

Assuming the ARC and GFI can be added at the panel, is there any good reason not to do so?

Good reason... ? It IS required from the code standpoint. From the contractor' standpoint,

...they [ might ] reference the cost factor to see if it will fly past the AHJ.

BTW, shouldn't this topic be posted in the Commercial Electrical section? ;)

Would you please point me to where in the code it is required, I'd appreciate it!
