Single egress in a R-2

I have a four story R-2 that has only two dwelling units on the basement, first, second, and third floors. The fourth floor is areas and spaces tha are part of the dwelling units that are on the third floor. (the top two floors contain two story dwelling unit, whose entries are on the third floor). Travel distanced within these dwelling units is less than 125 feet.

I am of the position that this complies with the intent of section 1021.2 and table 1021.2(1) base on the fact that the entries are locatedon the third floor and this building can be served with one exit stair.

Please share your thoughts.

I don't think so.
Table 1021.2(1) says 4th story and above not permitted. The table goes by stories that are occupied, not where the unit entrance is.
I don't see any exceptions that say the 4th floor does not count for 2 story units on the 3rd floor.
