Stair Landing Question

I am converting a non-contiguous basement into habitable space. There is an existing outswing door. The reviewer is requiring that we create a 36" landing at the top of the stairs which would require us to do a bunch of work.

I don't see the safety issue as the doors operation essentially creates a landing but if that is the only way, it is the only way.

Does anyone have a work around?
 
2020 LA County based on 2019 CRC and 2018 IRC
R311.7.6 Landings for stairways. There shall be a floor or landing at the top and bottom of each stairway. The width perpendicular to the direction of travel shall be not less than the width of the flight served. For landings of shapes other than square or rectangular, the depth at the walk line and the total area shall be not less than that of aquarter circle with a radius equal to the required landing width. Where the stairway has a straight run, the depth inthe direction of travel shall be not less than 36 inches (914mm).

Exception: A floor or landing is not required at the top of an interior flight of stairs, including stairs in an enclosed garage, provided that a door does not swing over the stairs.


what does this mean---"non-contiguous basement"? Is the stairway and interior flight?
