Two-Way Communication required?

In NYS an existing 2-story building of construction classification type VB, only partially sprinklered and B occupancy proposes to install an elevator to get to the 2nd floor. It is agreed that an area of refuge is not required because the elevator is not part of an accessible means of egress. But according to BCNYS §1009.8 two-way communication is required at the landing serving each elevator on each accessible floor that is one or more stories above or below the level of exit discharge. Is the 2-way communication required? And, if my interpretation of this section is correct what part of the code sends me to this 1009.8 section? Or, is section 1009 only and specifically for accessible means of egress and this entire section cannot be applied?

Two-way communication is required. Whether an elevator is used as part of accessible means of egress or not, two-way communication is still required. If you have stairways with areas of refuge that have two-way communication, then two-way communication is at the elevator is not required. People with disabilities need to have some means of telling others that they are still in the building, and the two-way communication at the elevator provides that if no other two-way communication is provided.
