Unenclosed stairways

Has the allowance for unenclosed stairways in the 2006 IBC been removed from the 2009?

1020.1 exceptions 8 and 9 allowed unenclosed stairways and these exceptions are not included in the 2009 code.

This is a substantial change to the design requirements of buildings.

You can no longer design buildings with attractive open stairways??

Am I missing something?
 
1020.1 Vertical Exit Enclosures changed to 1022.1 Enclosures Required.

"Change Summary: Consistent with the provisions for shaft enclosures, the fire-resistance rating of an exit enclosure cannot be less than the rating of the floor construction penetrated by the enclosure."

"The previous Exception 4 addressing the enclosure of stairways that are not a require means of egress element has been deleted. Vertical openings created by such stairways continue to be regulated under the shaft enclosure provisions of Section 708. In addition, previous Exceptions 8 and 9 have been relocated to Section 1016.1 as two exceptions in regard to the allowances for not requiring enclosure of the stairways did not change"

Good. If an unenclosed stair is not part of the means of egress it should not be in the means of egress chapter.
