What would you do? Breaker Panel behind generator.

OK, so you are called out to inspect a new generator and you find this. The generator company swears the new generator is in the same location as the old and the issue with workspace was pre-existing. You then find out that they will be changing the breaker inside that box and you will eventually have to inspect it.

Do you mandate that the panel be moved?

Should the generator company have put moving the panel in their bid anyway?

Should the electrical contractor hired by the generator company have flagged this already?

Will you just let it go and inspect everything other than workspace requirements?

There is a basic understanding in the code / all codes that if you touch it, it has to comply. Yes it is existing, should not have been left or installed that way to begin with. Everyone, on this job is the blame for what was left after the new genset. I would have them move it for proper space.
 
'Existing' is a defined term which means lawfully in existence.
'Pre-existing' is a Zoning term and has ne place in a building code discussion.
I too would require the non-compliant installation to be corrected.
