ADA has the elevator exemption for three stories and under. 2009 IBC 1007.1 ex. 1, "Accessible means of egress are not required in alterations to existing buildings."
 
Now I'm confused...I just read 2009 IBC 3411.4.2 which seems to contradict 1007.1 ex. 1
 
1007.1 is for accessible egress

3411.4.2 is when a entire building undergoes a change of occupancy.

You should be looking at 3411.4.1 which will send you to 3411.7 and exception 1 will more than likely be the exception for an elevator

AKA 20% rule
