Anyone ever noticed this? I've read this code section many times over the years and just realized it's impossible to meet this code....NC Residential Code section 312.2, exception 2 says "2. Where the top of the guard also serves as a handrail on the open sides of stairs, the top of the guard shall not be not less than 34 inches (864 mm) and not more than 38 inches (965 mm) measured vertically from a line connecting the leading edges of the treads."

Must be a grammatical error not caught by a proofreader, but it says what it says.
 
Most peoples brains are wired to fix that sort of mistake without letting the person know about it. Apparently Mr. Triplett is not most people.
 
You must be using a version of the 2009 IRC.
This section had several proposed revisions from the 2006 IRC and the proposal approved as submitted contained the double negative (E85-06/07 Part II). https://www.iccsafe.org/cs/codes/Documents/2007-08cycle/ProposedChanges/V1_E85-171.pdf

2. Where the top of the guard also serves as a handrail on the open sides of stairs, the top of the guard shall
not be not less than 34 inches (864 mm) and not more than 38 inches (965 mm) measured vertically from a

This reads correctly in 2012 & 2015.
2. Where the top of the guard serves as a handrail on the open sides of stairs, the top of the guard shall be not less than 34 inches (864 mm) and not more than 38 inches (965 mm) as measured vertically from a line connecting the leading edges of the treads.

If you were to report this to ICC as an errata they would repond that it's not an errata because that's what the voters approved.

Submit a correction to the appropriate authority, request a clarification and an errata to be issued.
Hopefully it will be fixed in the next edition. I just find things like this humorous, like the sign that reads "extra sauce is .39 cents". I'm so tempted to ask for extra sauce just so I can give them a penny and then debate their sign.
