New Building first tenant buildout of this space

Hi Folks,

I've got a customer who just purchased a new commercial condominium the building is only one year old and was built an approved by the city for accessibility compliance. Now I'm trying to get a permit to perform the tenant buildout, it's a ground floor space and the city is requiring me to spend 20% of my budget on improving accessibility.

There is literally nothing that needs improving. How would you handle this one?

How do you know that it was approved for accessibility compliance?

Do you have hard copied records, or just a verbal approval? Just

because a C. of O. was issued does not mean "actual" compliance.

The code requires up to 20% for features that are feasible, or document there is full compliance. In your case, you should be able to document full compliance

In this town nothing commercial is occupied without a final. But I will ask the owner's association for information on the original permit.

Nicely ask the AHJ to do a walk through with you and point out anything that you could improve, 20% of zero........is zero.

Thanks Guys,

I thought I was trapped in an impossible situation. Hadn't realized that previous full compliance could be used to deflect the 20% requirement.

I will set up a walk through next week and I will ask nicely. Course, if an issue does come up I will wonder how it was accepted last year. 8-)

The building was constructed as a shell to be sold as condominiums for offices. I suggest no change in use. Any AHJ that approved a building permit with a deferred approval for occupancy is only inviting a lawsuit.

Perhaps the prior approval was only for the site and exterior portions? Does the buildout of the tenant space include rest rooms, customer service areas, etc?
 
Actually. I misstated my problem in my original post. The claim that the city was requiring the 20% improvement was second hand information from my designer. Once I got in communication with the plans reviewer he was ok with no improvement as long as I could provide him with the building permit number for the shell project.

This time the system worked.

KZQuixote, it's actullay 25% by statute in Oregon. A one year old building should be fully compliant. Ask them what they missed on their final inspection that needs to be done now.
