Type 2 SPD and Tap Rules

What I have here is a 2000 amp switch board and from the load side of service disconnecting means is a #10 thhn tap approx 8' in length in emt to a 30 amp fused switch then close nippled to the TVSS / SPD. My question is do TVSS / SPD's have to follow tap rules? Here are my references. 08' NEC 285.24(A), 230.82(8), 240.21(B)(1)......I say it is a violation. The EE is saying this was approved and stamped drawings and we do it all the time in DC, Md, and Va.

Eventually to a TVSS (Transient Voltage Surge Suppressor) or SPD (Surge Protective Device) This would be I assume a Type 2 per 285.24.

Forgot one more to your question. Load side of the 2000 amp gear now feeders, 6 sets of 750 mcm AA8000 al.
