What determine the amount of accessibility?

1 Story Existing Restaurant with an outdoor deck /lounge area (intended to serve food).

Scope of work: extend deck area (not fixed seating) (12' x 21')

Client wants the new concrete deck to have a 6" step, so the new addition will not be accessible.

Me being more of a residential type of architect, I was wondering what determine the amount of accessibility required?

All I can find was from IBC:

1108.2.9 Dining areas. In dining areas, the total floor area

allotted for seating and tables shall be accessible.

Your under IBC 2003?. It is very easy to make a 6" elevation change accessible. More than likely you would only need to make 5% of each type of seating accessible, but if this new raised area provides any different type of experience, seating option, view, or amenities then the area itself will need to be accessible.

I see where it says:

1108.2.9.1 Dining surfaces. Where dining surfaces for

the consumption of food or drink are provided, at least 5

percent, but not less than one, of the seating and standing

spaces at the dining surfaces shall be accessible and be

distributed throughout the facility.

But, 1108.2.9 says:

1108.2.9 Dining areas. In dining areas, the total floor area

allotted for seating and tables shall be accessible.

So, I figure the whole dining area needed to be accessible and in that area at least 5% needed to comply with ANSI A117.1 902 (Dining Surfaces and Work Surfaces)

Am I misunderstanding it?

Looks like you got it....Don't forget Chapter 34 or IEBC for alterations and additions and stuff....

This is a new space, it needs to be accessible. "....and be distributed throughout the facility. provide a ramp, or lower it.

There is an exception in the ADASAD for addition s and remodels that the raised "platform" in restaurants do not need to be accessible, but many states require the platform to be accessible.

I should have clarified... it's a 6" step down. The step is there for no other reason than aesthetics (and create a tripping hazard).

Thanks Mark, I found the section that you are referring on my copy of 2010 ADASAD... (My county is on 2003 ANSI though). I'll look for the exception on ANSI...
